Moto Health Terms & Conditions

Please read these terms carefully before using our services. These terms govern your use of our healthcare transport platform.

1. Introduction

1.1 These Terms & Conditions ("Terms") govern your registration, access to and use of our mobile application, website and any other platform or service we provide (collectively, the "App" or "Services").

1.2 By registering for or using our Services you accept and agree to be bound by these Terms. If you do not agree to these Terms you must not register for or use the Services.

1.3 You acknowledge that our Services consist of a technology platform that facilitates hospital transfers (i.e., transporting registered users ("Passengers") between healthcare facilities or to/from such facilities) by connecting you with drivers who are independently trained in first aid by the Kenya Red Cross Society ("Drivers"). We are not the carrier of the Patient/Passenger ourselves.

1.4 We may amend these Terms at any time. Such amendments will become effective when we post the revised Terms on our App or website. Your continued use of the Services after such posting constitutes your acceptance of the amended Terms.

2. Who can use the Services

2.1 To register for and use the Services you must be at least 18 years old, or of legal majority in your jurisdiction.

2.2 You must provide accurate, complete and up-to-date account information when registering and maintain this accuracy.

2.3 You agree that you are responsible for all activity under your account (including bookings made by others with your credentials).

2.4 You must only use the Services for lawful purposes, and in compliance with all applicable laws and regulations in Kenya, including those relating to healthcare transport and data protection.

3. Our role & your understanding

3.1 We provide a matching platform: we connect you (Passenger) with a Driver; we do not directly provide the transport service. Each Driver is an independent contractor, not our employee.

3.2 You acknowledge and agree that we are not a carrier, hospital, ambulance service, or emergency medical services provider. Our role is limited to facilitating the booking and matching process.

3.3 While Drivers are trained in firstaid by Kenya Red Cross, this does not replace full ambulance services, advanced medical care or guarantee a specific clinical outcome.

3.4 You acknowledge that use of the Service may involve risks (traffic accident, delays, medical deterioration during transfer) and you accept those risks in using our platform.

4. Booking, service usage and fees

4.1 To request a transfer you must use the App and pay any applicable fees as shown.

4.2 Once you have booked and a Driver is assigned the Service is considered to have commenced. You may cancel before Driver arrival subject to any cancellation policy as specified in the App.

4.3 Fees for the Service will be displayed in the App at booking. You agree that we may charge your registered payment method. All fees are nonrefundable unless otherwise stated.

4.4 You are responsible for any additional costs associated with your transfer (e.g., hospital charges, medical equipment required beyond first aid, delays caused by you).

4.5 You must ensure that you or your representative are ready for pick-up at the scheduled time and place. Delays beyond a certain threshold may incur additional waiting fees at our discretion.

5. Your conduct & obligation as Passenger

5.1 You must comply with all instructions given by the Driver, including health & safety instructions and any facility/hospital protocols.

5.2 You must treat the Driver and any other person with respect, and not cause nuisance, harassment, damage, or behave unlawfully. We reserve the right to suspend or terminate your account for misconduct.

5.3 You must not misrepresent your health status or need for transfer in order to misuse the Service.

5.4 You must ensure that you have any required permission from the hospital or medical facility for the transfer. We are not responsible for any refusal of admission or transfer by a hospital.

6. Driver obligations

6.1 Each Driver is independent and has been trained in first aid by the Kenya Red Cross.

6.2 Drivers will comply with applicable laws (traffic, health & safety) and any rules or protocols set by hospitals or our company.

6.3 Drivers are responsible for the vehicle, its maintenance, insurance and licensing. We do not guarantee the state of the vehicle beyond our selection/qualification process.

6.4 If a Driver fails to attend or is delayed beyond a certain threshold we will attempt to reassign another Driver or refund/credit according to our cancellation policy.

7. Liability & disclaimers

7.1 To the extent permitted by law, we disclaim any liability for damages, losses or harm resulting from your use of the Services  including but not limited to personal injury, medical deterioration, death or property damage.

7.2 We make no guarantee that every booking will be accepted, that every journey will be completed without interruption, or that the Driver's first aid training will cure, treat or prevent any medical condition.

7.3 We are not liable for any refusal of hospitals/facilities to accept the transfer, or for any medical outcome following the transfer.

7.4 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for any other liability which cannot by law be excluded or limited.

8. Payment & charges

8.1 You must pay any fee shown in the App for the Service plus any applicable taxes, surcharges or waiting/time-based fees.

8.2 If your payment method fails or you have outstanding debts to us, we may suspend or terminate your access to the App.

8.3 We may introduce new fees or modify existing fees at any time; any changes will be communicated to you and apply to future bookings only.

9. Data protection & privacy

9.1 We collect, store and use your personal data (name, contact, health information, transfer records, payment info) to provide the Services and in accordance with our Privacy Policy.

9.2 You consent to our use of this data and to its sharing (where necessary) with Drivers, hospitals/medical facilities, or insurers to fulfil the Service.

9.3 You must ensure that any health information you provide is accurate and you authorise the release of whatever information is required for the transfer.

9.4 We will handle your data in compliance with applicable Kenyan data protection laws.

10. Termination & suspension

10.1 We may suspend or terminate your access to the Services at any time (for example, for misconduct, fraudulent use or repeated cancellations) with or without notice.

10.2 You may terminate your account at any time via the App. Any outstanding payments must still be paid.

10.3 On termination your rights to use the App cease; any provisions intended to survive termination (liability, indemnities, etc) will remain in force.

11. Governing law & dispute resolution

11.1 These Terms are governed by and construed in accordance with the laws of Kenya.

11.2 Any dispute arising out of or in connection with these Terms or your use of the Services shall be submitted to the competent courts of Kenya.

11.3 If you are a consumer, nothing in these Terms will affect your statutory rights.

12. Intellectual property & licence

12.1 We grant you a limited, non-exclusive, non-transferable licence to access the App for your personal use in accordance with these Terms.

12.2 All content, trademarks, logos, software and other rights in the App remain ours or our licensors'. You must not copy, reverse engineer, distribute, sell or otherwise misuse the App or its content.

13. Amendments

13.1 We may amend these Terms at any time by posting revised Terms on our App or website. We will indicate the date of last modification.

13.2 Continued use of the Services after amendment constitutes your acceptance of the revised Terms. If you do not agree to the new Terms you must stop using the Services and close your account.

14. Miscellaneous

14.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.2 No waiver by us of any right under these Terms constitutes a waiver of any other right.

14.3 These Terms constitute the entire agreement between you and us regarding your use of the Services and supersede any prior agreements or understandings.
